Disabled Person’s Trust (in your will)

No one likes to think of dying before their children, but this can be even more stressful if you have a disabled child who will need special care throughout their lives. This is something that should be addressed in a Will.

Leaving a large lump sum for the care of your disabled child in your Will, may actually prevent them from accessing means tested benefits in the future which could be detrimental to their overall care.

In order to prevent this from happening you can set up Disabled Person’s Trust (in your will) which enable property, cash or investments to be held in trust on behalf of your beneficiary.

A Disabled Person’s Trust is specifically for a beneficiary who is incapable of managing their own affairs, or if they are receiving Attendance Allowance, Disability Living Allowance or Personal Independence Payment.
